These Terms are provided for general information and have not been reviewed by a licensed Utah attorney. Casteca Homes LLC should have a qualified attorney review them before relying on them.

1. Acceptance of These Terms

By accessing or using the website at https://castecahomes.com(the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site. These Terms are a legal agreement between you and Casteca Homes LLC, a Utah limited liability company (“Casteca Homes,” “we,” “us,” or “our”). We may update these Terms at any time, and your continued use of the Site after an update constitutes acceptance of the revised Terms. The “Last updated” date above shows when the most recent revision was made.

2. Who We Are

Casteca Homes LLC is a Utah limited liability company and licensed general contractor specializing in custom residential construction. We serve clients in Washington, Iron, and Kane counties in Southern Utah, with our principal office in St. George, Utah, and a studio in Cedar City, Utah. The Site is a marketing and informational website. Its purpose is to introduce prospective clients to our services, show the kind of work we do, and let interested parties contact us. Browsing the Site, submitting a contact form, scheduling a discovery call, or any other interaction does not create a contractor-client relationship, a construction contract, or any binding obligation. Any actual home-building relationship between you and Casteca Homes LLC is governed exclusively by a separately negotiated, separately executed written contract signed by authorized representatives of both parties. No statement, email, text message, proposal, or content on this Site modifies or supersedes a fully executed written construction contract.

4. Disclaimers Regarding Site Content

Concept Homes, Renderings, and Plans Are Illustrative Only

The Site may display concept homes, floor plans, elevations, renderings, photographs, and descriptions. These materials are illustrative examples of the type and style of work we do. They do not represent homes currently available for immediate purchase, construction, or replication unless a separate written agreement specifically says so.

Pricing and Cost Information Is Illustrative Only

Any pricing, cost-per-square-foot figures, budget ranges, or estimates shown on the Site are illustrative approximations only. They are not quotes, bids, or binding price commitments. Actual costs vary based on lot characteristics, soil conditions, design complexity, material selections, market conditions, labor availability, permitting, and scope. Do not make financial commitments based on pricing shown on the Site. A formal written proposal or contract is the only reliable source of pricing for your project.

Timelines and Availability Are Not Guaranteed

References to project timelines, construction durations, or scheduling windows are general estimates, not guarantees. Actual schedules depend on design approvals, permitting, weather, material lead times, subcontractor availability, and other factors outside our control. Any timeline commitment is made only in a signed construction contract. References to homes or lots as “available,” “concept,” or similar reflect information at the time of publication and may be out of date; availability is confirmed only in writing.

No Warranty for Site Content

We make reasonable efforts to keep Site information accurate and current, but we do not warrant that any content is complete, accurate, error-free, or up to date. We may correct, modify, or withdraw content at any time without notice.

5. No Warranty: Site Provided “As Is”

THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CASTECA HOMES LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Any warranty relating to construction workmanship, materials, or systems is defined exclusively in, and limited to, a separately executed written construction contract between you and Casteca Homes LLC. Nothing on this Site creates or implies any construction warranty. Where Utah law requires implied warranties that cannot be disclaimed (such as the implied warranty of habitability for new residential construction), those apply only to the extent required by law and only to work performed under a signed contract.

6. Intellectual Property

All content on the Site, including text, photographs, renderings, floor plans, concept designs, graphics, logos, video, and the selection and arrangement of that content, is owned by or licensed to Casteca Homes LLC and protected by United States copyright, trademark, and other intellectual property laws. You may view and print a single copy of pages for your own personal, non-commercial use. You may not reproduce, distribute, or republish Site content without our prior written permission, use it for commercial purposes, create derivative works from it, remove proprietary notices, or use automated means to scrape or index it. The Casteca Homes name, logo, and marks are trademarks of Casteca Homes LLC; nothing here grants you a license to use them.

7. User Conduct

When you use the Site, you agree that you will not:

• Provide false, misleading, or fraudulent information
• Use the Site for any unlawful purpose or in violation of any law
• Attempt to gain unauthorized access to the Site or its infrastructure

TO THE FULLEST EXTENT PERMITTED BY UTAH LAW, CASTECA HOMES LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS INFORMATION, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR DECISIONS MADE IN RELIANCE ON SITE CONTENT. IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00). THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Governing Law and Venue

These Terms and any dispute arising from your use of the Site are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any action arising under or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Washington County, Utah. You consent to personal jurisdiction there and waive any objection to venue.

12. Dispute Resolution

Please contact us first at sales@castecahomes.com to resolve any dispute informally. Nothing in this section prevents either party from seeking emergency injunctive or equitable relief when necessary to prevent irreparable harm. Any dispute arising from a construction contract between you and Casteca Homes LLC is governed by the dispute resolution provisions of that contract, not by these Terms.

13. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14. Entire Agreement (as to Website Use)

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Casteca Homes LLC regarding your use of this Site, and supersede prior communications and agreements about Site use. They govern your use of this website only and do not modify or supersede any construction contract or other written agreement separately executed between you and Casteca Homes LLC.

15. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the “Last updated” date above. Your continued use of the Site after a revision constitutes acceptance of the revised Terms.
