1. Who We Are

Casteca Homes LLC is a Utah limited liability company and licensed general contractor specializing in custom home building. We serve clients in Washington, Iron, and Kane counties in Southern Utah. Our principal place of business is in St. George, Utah, and we maintain a studio in Cedar City, Utah.

This Privacy Policy applies to information collected through our website at https://castecahomes.com(the “Site”). It explains what personal information we collect, why we collect it, how we use it, who we share it with, and what rights you have under applicable law, including the Utah Consumer Privacy Act. By using the Site, you acknowledge that you have read and understood this Privacy Policy.

2. Information We Collect

We collect personal information in two ways: information you provide directly to us, and information collected automatically when you visit the Site.

Information You Provide Directly

When you submit our contact form or schedule a discovery call through the Site, you may provide your full name, your email address, your phone number, and project details such as the type of home you are considering, your approximate budget, your preferred location, and anything else you choose to share in a free-text field. You are not required to provide this information to browse the Site. Providing it is voluntary and is necessary only if you want us to contact you about your project.

Information Collected Automatically

When you visit the Site, our hosting infrastructure and analytics tools may automatically collect technical information, including your IP address, browser and operating system type, the pages you visit and time spent on them, the referring website, the date and time of your visit, and other standard server log data. This information is used to operate and maintain the Site and to understand general traffic patterns. It is not used to build individual behavioral profiles for advertising.

3. How We Collect Information: Forms, Cookies, and Analytics

We collect directly submitted information through the contact form on the Site and through our third-party scheduling tool, Cal.com, which lets prospective clients book a discovery call. The Site may use cookies for session functionality and for aggregate analytics. The Site is a marketing site and does not use cookies for behavioral advertising or cross-site tracking. Most browsers let you control cookies through your settings. If you disable cookies, some features may not work, but the informational content of the Site remains accessible. Any analytics we use are for improving the Site and our business, not for targeted advertising.

We share personal information only with service providers that process data on our behalf, under our instructions, for the limited purposes described here. They are contractually obligated to protect your information and may not use it for their own purposes. Our current providers are:

• Resend (transactional email delivery), which processes your name, email address, and message content to deliver your contact form submission to us.
• HubSpot (CRM and lead management), where we store contact details and project information so our team can track and follow up on inquiries.
• Cal.com (discovery-call scheduling), which collects your name, email address, and scheduling preferences to confirm and manage your appointment.

We may disclose personal information if required by law, court order, or government authority, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Casteca Homes LLC, our clients, or the public. If Casteca Homes LLC is involved in a merger, acquisition, or sale of substantially all of its assets, personal information we hold may be transferred as part of that transaction, and we will update this policy to reflect it.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described here and to meet our legal obligations. Contact form submissions and CRM records are kept for the duration of any active business relationship and a reasonable period afterward, typically up to three years from the last contact, unless a longer period is required by law or by an executed construction contract. Server logs are typically retained for up to 90 days. Aggregate, non-identifiable analytics may be retained indefinitely. When information is no longer needed, we delete or de-identify it.

7. Security

We use reasonable technical and organizational measures to protect personal information from unauthorized access, use, disclosure, alteration, or destruction, including standard transmission security (HTTPS) and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. 8. Your Privacy Rights Under the Utah Consumer Privacy Act

The Utah Consumer Privacy Act (Utah Code Ann. Section 13-61-101 et seq.), effective December 31, 2023, grants certain privacy rights to qualifying Utah residents. We honor these rights as a matter of good practice even where the Act’s applicability thresholds may not apply to a business of our size:

• Right to know (access). Confirm whether we process your personal data and request a copy of it.
• Right to deletion. Request that we delete personal data you provided, subject to legal exceptions.
• Right to data portability. Obtain your personal data in a portable, and where practicable, readily usable format.
• Right to opt out of sale and targeted advertising. Casteca Homes LLC does not sell personal data and does not conduct targeted advertising as defined by the Act, so there is no such activity to opt out of.

We will respond to verifiable requests within the timeframe required by the Act (generally 45 days, with a possible 45-day extension when reasonably necessary), and we will not discriminate against you for exercising your rights. If we decline a request, we will explain why and how to appeal. If you are dissatisfied with our response to an appeal, you may contact the Utah Division of Consumer Protection.

9. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, contact us at sales@castecahomes.com and we will promptly delete it.

10. Third-Party Links

The Site may link to third-party websites we do not operate. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party sites you visit. We are not responsible for their practices or content.
